LLSmartVerify End User License Agreement (EULA)

Product: LLSmartVerify™
Licensor:* e-Forensics Inc. (“e-Forensics”)
Updated Date: March 2026

1. AGREEMENT SCOPE.

This Master Services Agreement (“MSA”) governs the use of the LLSmartVerify™ Portal and the overarching "Triple-Lock" forensic framework.

2. USER ACCOUNTS.

Users must provide accurate registration data. You are solely responsible for the security of your Portal credentials.

3. THE FORENSIC CREDIT SYSTEM.

Framework usage is governed by Forensic Credits to anchor transactions. One credit facilitates one "Smart Contract" activation on the Blockchain. The initial purchase of an LLIMAGER™ License includes a bundle of complimentary Forensic Credits. These credits have no cash value, are non-transferable, and are consumed upon the initiation of a Blockchain anchoring transaction. Licensee acknowledges that additional Forensic Credit purchases made via the LLIMAGER website are provisioned manually by e-Forensics Inc. staff. This provisioning will be automated in the near future. Please allow up to twenty-four (24) business hours for credits to appear in the Portal. e-Forensics Inc. is not liable for delays in forensic field operations caused by the timing of manual credit provisioning.

4. NO CREDIT REFUNDS.

Credits are non-refundable and are consumed upon the attempt to anchor a hash to the Blockchain.

5. BLOCKCHAIN NETWORK RISKS.

Licensor utilizes Third-Party Blockchain Providers. We are not liable for network downtime, forks, or increases in "Gas" or transaction fees.

6. NON-ZERO-KNOWLEDGE (NZK) ARCHITECTURE. THE PORTAL IS NOT A ZERO-KNOWLEDGE ENVIRONMENT.

Metadata is encrypted, but administrative keys are held by the Licensor.

7. ADMINISTRATIVE ACCESS.

Licensor retains the technical capability to decrypt metadata for support, maintenance, and legal compliance.

8. DATA BREACH LIABILITY CAP.

In the event of an unauthorized data disclosure, Licensor’s liability is strictly capped at $100.00 USD.

9. CJIS NON-COMPLIANCE.

Licensor is NOT a CJIS-compliant entity. This Portal is not suitable for Criminal Justice Information (CJI).

10. DATA CONTAMINATION PROHIBITION.

Licensee is strictly prohibited from uploading government locational data or CJI to the Portal.

11. INDEMNIFICATION FOR CONTAMINATION.

Licensee shall indemnify Licensor for all costs associated with "cleaning" or purging unauthorized CJI data from the Portal.

12. GPS DATA AS PII.

Licensee acknowledges that GPS coordinates constitute high-sensitivity Personally Identifiable Information (PII) under global laws.

13. USER-CONTROLLED CAPTURE.

The decision to include GPS metadata in a scan rests solely with the Licensee.

14. THE SECRET SALT.

Metadata is protected by an off-chain Secret Salt before being hashed and anchored to the Blockchain.

15. RIGHT TO BE FORGOTTEN.

Compliance with GDPR/CCPA is achieved via "Crypto-Shredding" (the permanent destruction of the off-chain Secret Salt). Licensee acknowledges that the Blockchain is an immutable ledger. To fulfill "Right to be Forgotten" requests while maintaining forensic integrity, the Company utilizes a "Salt-Deletion" protocol. Upon a valid erasure request, the Company shall permanently destroy the unique off-chain Secret Salt associated with the record. This action renders the on-chain metadata hash mathematically un-linkable to any identifiable individual or Portal record. The remaining forensic image hash and timestamp are non-identifying data points and are retained to ensure the permanent, verifiable integrity of the original forensic acquisition.

16. ANONYMIZATION LEGALITY.

Once the Salt is destroyed, the on-chain hash is anonymized and no longer constitutes "Personal Data" under the law.

17. VERIFICATION WAIVER.

Licensee acknowledges that privacy compliance may render an acquisition log un-verifiable and waives all claims for such loss.

18. SUBPOENA REIMBURSEMENT.

Licensee shall pay Licensor $500/hr for any expert testimony or data retrieval required for Licensee’s legal matters.

19. PORTAL UPTIME.

Licensor provides no guarantee of 100% Portal availability. Service outages do not constitute a breach.

20. DATA RETENTION POLICY.

Portal metadata may be purged thirty (30) days after a subscription expires or is terminated.

21. INTELLECTUAL PROPERTY.

Licensor owns all rights to the "Triple-Lock" process, hashing logic, and portal source code.

22. AUDIT RIGHTS.

Licensor may audit account activity to ensure compliance with Forensic Credit usage.

The Portal may link to third-party blockchain explorers; we are not responsible for their content.

24. NO ADMISSIBILITY WARRANTY.

Licensor makes no warranty that blockchain anchoring will meet the requirements of any specific rules of evidence.

25. FORCE MAJEURE.

Licensor is not liable for outages caused by cloud provider failures (e.g., AWS/Azure).

26. EXPORT CONTROLS.

Accessing the Portal from sanctioned countries is strictly prohibited.

27. SEVERABILITY.

If any provision of this MSA is found invalid, the rest of the Agreement remains in effect.

28. GOVERNING LAW.

This Agreement is governed by the laws of the State of Florida, USA.

29. ARBITRATION.

All disputes shall be resolved via binding arbitration in the Licensor’s home county.

30. SURVIVAL.

Indemnity and liability clauses survive the termination of this Agreement.
