1. BINDING NATURE & PARTIES.

This EULA is a legal agreement between You (the End-User) and e-Forensics Inc. (“Company”). This Agreement is concluded solely between You and the Company, not with Apple Inc. or Google LLC. The Company, not Apple or Google, is solely responsible for the Licensed Application and its content.

2. SCOPE OF LICENSE.

The license granted to You is limited to a non-transferable license to use the App on any Apple-branded Products that You own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

3. MAINTENANCE AND SUPPORT.

The Company is solely responsible for providing any maintenance and support services for the App. You and the Company acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

4. WARRANTY & REFUNDS.

The Company is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Company’s sole responsibility.

5. PRODUCT CLAIMS.

You and the Company acknowledge that the Company, not Apple, is responsible for addressing any claims related to the App or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. INTELLECTUAL PROPERTY RIGHTS.

You and the Company acknowledge that, in the event of any third-party claim that the App or Your possession and use of the App infringes that third party’s intellectual property rights, the Company, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

You represent and warrant that (i) You are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a “terrorist supporting” country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.

8. THIRD-PARTY TERMS.

You must comply with applicable third-party terms of agreement when using the App (e.g., You must not be in violation of Your wireless data service agreement).

9. THIRD-PARTY BENEFICIARY.

You and the Company acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon Your acceptance of the terms and conditions of the EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against You as a third-party beneficiary thereof.

10. TRIPLE-LOCK™ FUNCTIONALITY.

The App serves as a mobile field-anchoring and verification tool within the LLSmartVerify™ framework, used to scan QR identifiers and transmit metadata to a centralized Portal.

11. GPS CAPTURE & USER OPT-OUT.

The App allows for the optional capture of precise GPS coordinates. Licensee acknowledges that GPS data is classified as Personally Identifiable Information (PII). FUNCTIONALITY NOTICE: Users may optionally exclude Geolocation data from the transaction within the App settings.

12. NON-CJIS COMPLIANCE DISCLOSURE.

e-Forensics Inc. is NOT a CJIS-compliant provider. This App is not certified for the storage or transmission of Criminal Justice Information (CJI). Users performing acquisitions for government agencies must manually disable GPS capture. Failure to do so constitutes a breach of professional duty by the Licensee.

13. DATA CONTAMINATION LIABILITY.

Licensee assumes all legal and financial liability for the unauthorized upload of CJI or government locational data to the Portal.

14. NON-ZERO-KNOWLEDGE ARCHITECTURE.

Data is transmitted to an encrypted Portal where Licensor retains administrative access keys. This is not a Zero-Knowledge environment. Licensee accepts the inherent risks of storing forensic metadata in a non-zero-knowledge cloud environment.

15. BLOCKCHAIN INTEGRATION & IMMUTABILITY.

Metadata is hashed with a salt and anchored to a Third-Party Blockchain Provider. Once a hash is anchored to the Blockchain, it is permanent. Licensor cannot edit, move, or delete anchored entries.

16. THE SALT-DELETION PROTOCOL.

To fulfill GDPR/CCPA "Right to be Forgotten" requests, the Company utilizes a "Salt-Deletion" protocol. Upon a valid erasure request, the Company shall permanently destroy the unique off-chain Secret Salt associated with the record. This action renders the on-chain metadata hash mathematically un-linkable to any identifiable individual. The remaining forensic image hash and timestamp are retained to ensure the integrity of the original acquisition is verifiable.

17. WAIVER OF VERIFICATION.

Licensee acknowledges that once a Salt is destroyed for privacy compliance, the blockchain record becomes un-verifiable. Licensee waives all claims for loss of data.

18. BIOMETRIC DATA PRIVACY.

FaceID/TouchID data is handled locally by the device’s Secure Enclave. Licensor never receives or stores biometric identifiers.

19. LIMITATION OF LIABILITY.

Licensor’s liability for App failure is limited to the refund of the App purchase price or $5.00, whichever is greater. Licensor is not liable for a court's failure to accept mobile-captured metadata as evidence.

20. TERM & SUBSCRIPTION.

This license remains in effect as long as the underlying LLIMAGER ™ companion app subscription is active. Use requires an active Mobile Access Subscription via the Store.
